March 31, 2026 Deadline for COVID-Era I-9 Compliance Review 

Employers who relied on pandemic-era flexibilities for Form I-9 verification should be aware of an important upcoming compliance deadline: March 31, 2026. The deadline represents a final opportunity to review and correct Forms I-9 completed using remote document inspection during COVID-19.  

With worksite enforcement continuing to increase, employers with remote or hybrid workforces during this period should take proactive steps now to ensure compliance and mitigate risk.  

Background: COVID-19 I-9 Flexibilities 

Beginning in March 2020, DHS allowed employers operating in remote environments to inspect Forms I-9 virtually and defer in-person inspection. These flexibilities remained in place through July 31, 2023. 

The March 31, 2026, Deadline 

By March 31, 2026, employers should: 

– Identify all Forms I-9 completed using remote inspection between March 20, 2020, and July 31, 2023 

– Confirm proper follow-up actions were taken, including physical, in-person document inspection, or use of a compliant alternative procedure for E-Verify users 

– Correct any deficiencies or errors 

Common Compliance Issues 

– No record of physical inspection 

– Missing or incorrect annotations 

– Incomplete sections 

– Improper use of remote procedures 

How to Correct I-9 Deficiencies 

– Do not backdate 

– Strike through errors 

– Add correct information, initial and date 

– Complete physical inspection if missing

Failure to comply with employment verification requirements may result in significant civil penalties. The March 31, 2026, deadline is a critical compliance milestone. Employers should act now to mitigate risk and ensure compliance.
