Individuals seeking to file applications for adjustment of status with USCIS must use the “Final Action” dates for determining when they can file such applications. 

Dates of Filing: 

All Chargeability (all countries except those otherwise listed): 

• EB-1 remains current. 
• EB-2 remains November 15, 2023. 
• EB-3 moved forward to May 1, 2023. 
• EB-3 other workers remains July 22, 2021. 

China: 

• EB-1 remains January 1, 2023.
• EB-2 remains January 1, 2021. 
• EB-3 remains December 22, 2020. 
• EB-3 other workers remains January 1, 2018. 

India: 

• EB-1 remains April 15, 2022. 
• EB-2 remains February 1, 2013. 
• EB-3 remains June 8, 2013. 
• EB-3 other workers remains June 8, 2013. 

Mexico and Philippines: 

• EB-1 remains current. 
• EB-2 remains November 15, 2023. 
• EB-3 moved forward to May 1, 2023. 
• EB-3 other workers remains July 22, 2021.
