Individuals seeking to file applications for adjustment of status with USCIS must use the “Dates of Filing” dates for determining when they can file such applications.
Dates of Filing:
All Chargeability (all countries except those otherwise listed):
- EB-1 remains current.
- EB-2 remains August 1, 2023.
- EB-3 remains March 1, 2023.
- EB-3 other workers remains May 22, 2021.
China:
- EB-1 remains January 1, 2023.
- EB-2 remains October 1, 2020.
- EB-3 remains November 15, 2020.
- EB-3 other workers remains January 1, 2018.
India:
- EB-1 remains April 15, 2022.
- EB-2 remains January 1, 2013.
- EB-3 remains June 8, 2013.
- EB-3 other workers remains June 8, 2013.
Mexico and Philippines:
- EB-1 remains current.
- EB-2 remains August 1, 2023.
- EB-3 remains March 1, 2023.
- EB-3 other workers remains May 22, 2021.
Final Action Changes:

- EB-2 moved forward to April 1, 2023.
