Employers Should Note Minor Changes to Form I-9, Employment Eligibility Verification

Form I-9, Employment Eligibility Verification – which employers must complete for all individuals hired for employment in the United States – has just been updated. However, most employers can continue using the existing version until 2027.

The new edition, dated 01/20/2025, introduces only nominal changes:

  • Renaming the fourth checkbox in Section 1 to “An alien authorized to work” (replacing “A noncitizen authorized to work”)
  • Revising the descriptions of two List B documents in the Lists of Acceptable Documents 
  • Adding statutory language and a revised DHS Privacy Notice to the instructions

Regardless of the changes, most employers may continue using the existing version until 2027.

What You Should Do

  • Prepare to use the new 01/20/2025 edition by 08/01/2026.
    • Until 08/01/2026, employers may use:
      • The new 01/20/2025 edition, or
      • The edition dated 08/01/2023 with expiration date 05/31/2027; or
      • The edition dated 08/01/2023 with expiration date 07/31/2026.
        • (Employers using this form must update their systems with the 05/31/2027 expiration date by 07/30/2026.)
