The $100K H-1B Fee and the Value of Joining the U.S. Chamber of Commerce

As previously reported, the U.S. Chamber of Commerce is currently seeking to enjoin the Administration’s illegal H-1B $100,000 fee. For clients and others impacted by the illegal H-1B fee who are not currently members of the Chamber, we believe it is worthwhile to consider joining the Chamber at this time.

Our reason is simple. While the scope and outcome of the litigation remain uncertain, existing members of the Chamber at the time of the court’s decision would likely have the highest probability of benefiting from that decision. It is also critical to note that, in its most recent filing, the government has asked the court to limit any potential relief solely to Chamber members, meaning that companies already holding membership at the time of a potentially favorable ruling would be in the strongest position to benefit.
