REAL ID Requirement Takes Effect on May 7, 2025

Overview

The long-anticipated implementation of the REAL ID Act will take effect nationwide on May 7, 2025.

Under this federal law, individuals must present a REAL ID-compliant driver’s license or state-issued ID, or a valid U.S. passport, to board domestic flights or enter secure federal facilities. To obtain a REAL ID, applicants must provide documentation verifying identity, Social Security number, residency, and signature to their state’s driver’s licensing agency.

What is a REAL ID?

A REAL ID is a driver’s license or state-issued identification card that meets enhanced security standards set by the REAL ID Act of 2005. This ID is designed to be more secure than traditional driver’s licenses and will be mandatory for domestic air travel and access to certain federal buildings starting May 7, 2025.

When Do You Need a REAL ID?

1. Domestic Air Travel:
Beginning May 7, 2025, the Transportation Security Administration (TSA) will require a REAL ID or an acceptable alternative such as a U.S. passport to board domestic flights.

2. Access to Federal Facilities:
A REAL ID will also be necessary to enter secure federal buildings and military bases.

Documents Required to Get a REAL ID

To apply for a REAL ID-compliant license or ID, individuals must submit the following to their state’s licensing agency:

  • Proof of Identity:
    U.S. birth certificate, U.S. passport, or Permanent Resident Card (Green Card) for non-citizens.

  • Proof of Social Security Number:
    Social Security card, Form W-2, or a recent pay stub.

  • Proof of Residency (2 items):
    Acceptable documents include a utility bill, bank statement, or lease agreement showing your current address.

  • Proof of Signature:
    Examples include a credit or debit card, canceled check, or current state-issued license or ID.


What This Means for Employers

Employees—both U.S. citizens and foreign nationals—who travel domestically for business must carry a REAL ID-compliant document or a valid U.S. or foreign passport.

  • For foreign nationals, an unexpired foreign passport, when presented with a valid visa and Form I-94, will suffice for domestic travel.

  • Employers should advise employees who frequently travel for work to apply for a REAL ID well in advance of the May 2025 deadline due to possible processing delays.
