Visa Integrity Fee
Attendee Question: “Will there be a visa integrity fee for CW visas?”
🎙️ Attorney Insight (Matthew Hellrung): The U.S. Department of State has introduced a $250 visa integrity fee for nonimmigrant visa applications. This will be collected during the stamping process abroad and applies broadly, including categories like CW and H-1B1. -
H-1B & Specialty Visas
Attendee Question: “Will this fee apply to H-1B1 Chilean visa applicants?”
🎙️ Attorney Insight (Matthew Meltzer): Yes — H-1B1 visa applicants are also subject to the integrity fee under current policy. -
Maintaining Status & I-94 Compliance
Attendee Question: “Is there anywhere I need to update my I-94 status after a 24-month extension?”
🎙️ Attorney Insight (Matthew Hellrung): Your I-94 governs your authorized stay in the U.S. Once it nears expiration, you must file an extension to maintain valid status. Your employer may require you to update your Form I-9 with your new expiration date but, other than that, no separate update is required — although employers and employees should carefully monitor I-94 expiration dates to avoid lapses in status or work authorization. -
Birthright Citizenship
Attendee Question: “Can children born now, before any change, still be U.S. citizens?”
🎙️ Attorney Insight (Matthew Meltzer): Yes — children born in the U.S. before any change remain U.S. citizens, even under President Trump’s proposed executive order. -
Visa Bond Pilot Program
Attendee Question: “Where can I learn more about the visa bond pilot?”
🎙️ Attorney Insight (Michael Turansick): The program allows consulates to collect a refundable visa bond as a deterrent against overstays.
