DHS Rescinds Termination and Extends TPS Designations for El Salvador, Honduras, Nepal, and Nicaragua

On Tuesday June 13th, 2023, the Department of Homeland Security (DHS) announced the recission of the prior administration’s termination of the Temporary Protection Status (TPS) designations for El Salvador, Honduras, Nepal, and Nicaragua. The four countries will also get an 18-month TPS extension.

Secretary of Homeland Security Alejandro Mayorkas noted the extension is aimed at helping aid “current beneficiaries who…are already present within the U.S. and cannot return because of the impacts of environmental disasters”.

Federal Register notices will soon be published explaining the eligibility criteria, timelines, and procedures necessary for current beneficiaries to re-register for TPS and renew their Employment Authorization Documents. Once published, existing TPS beneficiaries under the four designations will be able to re-register their TPS throughout the 18-month extension. For those who arrived in the U.S. after the continuous residence dates for their respective country are not eligible for TPS. The continuous residence dates for each country are Feb. 13, 2001, for El Salvador; December 30, 1998, for Honduras and Nicaragua; and June 24th, 2015, for Nepal.

DHS has also previously extended the validity of TPS-related documentation for current beneficiaries who are nationals of El Salvador, Honduras, Nepal, and Nicaragua through June 30th, 2024.

The details for the 18-month extension and re-registration differ depending on the designation:

  • The designation of El Salvador has been extended from September 10th, 2023, through March 9, 2025. Existing beneficiaries who wish to extend their status through March 9, 2025, must re-register sometime between July 12th, 2023, and September 10th, 2023.

  • The designation of Honduras and Nicaragua has been extended from January 6th, 2024, through July 5th, 2025. Existing beneficiaries who wish to extend their status through July 5th, 2025, must re-register sometime between November 6th, 2023, through January 5th, 2024.

  • The designation of Nepal has been extended from December 25th, 2023, through June 24th, 2025. Existing beneficiaries who wish to extend their status through June 24th, 2025, must re-register sometime between October 24th, 2023, and December 23rd, 2023.
