USCIS Revises Guidelines on Date of Filing for I-485 Petitions

The Visa Bulletin will now have two different charts because of the revised procedures. DOS will post two charts per visa preference category in the DOS Visa Bulletin. The charts are: Application Final Action Dates (dates when visas may finally be issued); and Dates for Filing Applications (earliest dates when applicants may be able to apply). When USCIS determines there are immigrant visas available for the filing of additional adjustment of status applications, the Dates for Filing Applications chart may be used to determine when to file an adjustment of status application with USCIS.  Otherwise, the Application Final Action Dates chart must be used to determine when to file an adjustment of status application with USCIS. USCIS will determine which chart is effective for the following month approximately one week after DOS publishes and we will post that chart on this page.  USCIS will publish this information online. In coordination with the DOS, USCIS will monitor visa numbers each month and post the relevant chart on this page under When to File.

September 2015 Visa Bulletin

The September 2015 visa bulletin has been published by the Department of State. EB-2 India retrogressed over 2 years ands is not projected to move forward again until October. EB-2 China retrogressed almost 8 years. EB-3 for all countries but China, India, and the Philippines are at July 15, 2015, which functionally makes the category current given the time it takes a PERM to be certified by the Department of Labor. EB-3 for China, India, and Philippines are now at December 22, 2004.

August 2015 Visa Bulletin

The August 2015 visa bulletin has been published by the Department of State. EB-2 India did not move and is not projected to move again until October. EB-2 China moved 2.5. EB-3 for all countries but China, India, and the Philippines are at July 15, 2015, which functionally makes the category current given the time it takes a PERM to be certified by the Department of Labor. EB-3 for China, India, and Philippines are now at June 1, 2004. This means EB-3 China has retrogressed 7 years.

July 2015 Visa Bulletin

The July 2015 visa bulletin has been published by the Department of State. EB-2 India did not move and is not projected to move again until October. EB-2 China moved 4 months and EB-3 China did not move. EB-3 for all countries but China, India, and the Philippines are at April 1, 2015, which functionally makes the category current given the time it takes a PERM to be certified by the Department of Labor. EB-3 China is unlike to progress until October.

EB-3 Philippines is currently unavailable for this month.

The June 2015 visa bulletin has been published by the Department of State. EB-2 India will move ahead 3.5 months to October 1, 2008. EB-2 China has moved 1 year and EB-3 China has moved 4 months. EB-3 for all countries but China, India, and the Philippines are at February 15, 2015, which functionally makes the category current given the time it takes a PERM to be certified by the Department of Labor.
